Occupational asthma is regarded as one of the major occupational health problems.
The Control of Substances Hazardous to Health Regulations (COSHH) requires employers to control exposure to hazardous substances in order to protect his employees’ health. The Regulations state that employers must assess the risk of exposure when a particular substance is being used and if there is a risk of harm, the harmful product should be substituted with a less harmful product.  Further, the Regulations provide that your employer should undertake health surveillance involving the collection and use of information about their workers’ health relating to the substances used.  This helps to prevent asthma and other respiratory diseases, such as Chronic Obstructive Airways Disease, Emphysema, and Pneumoconiosis from developing by detecting early warning signs.

Workers involved in bakeries, food processing, painting, welding and the cleaning services are most at risk of developing respiratory problems.

“Common symptoms include coughing, wheezing, shortness of breath and tightness in the chest.”

If you believe that you have suffered respiratory problems as result of your work environment, you may be entitled to claim compensation.  Legal aid is not available for these types of claims and we therefore offer assistance under a No Win No Fee Agreement.
